PRIVACY POLICY

The GDPR is the new law for the protection of privacy and personal data. Under this law, an organization that works with personal data has certain obligations and the person to whom the data belongs has certain rights. In addition to this general law, specific rules apply to privacy in healthcare. These rules are stated, among other things, in the Medical Treatment Agreement Act (WGBO). This privacy statement is intended to inform you about your rights and our obligations under the GDPR and the WGBO.

SALBAR FYSIOTHERAPIE

At Salbar Fysiotherapie, various personal data about you can be processed. This is necessary to provide you with (medical) treatment and for the financial settlement of the treatment.

The Duties of Salbar Fysiotherapie

According to the GDPR, Salbar Fysiotherapie is responsible for the processing of personal data in the practice. The practice complies with the obligations arising from this as follows:

  • Your data is collected for specific purposes:

    • for physiotherapeutic care;

    • for effective management and policy;

    • to support scientific research, education, and information.

  • In principle, no processing takes place for other purposes.

  • You will be informed that your personal data is being processed. This can be done by your healthcare provider, via a brochure, or on our website.

  • All employees within Salbar Physiotherapy are committed to treating your personal data confidentially.

  • Your personal data is well protected against unauthorized access.

  • Your personal data will not be kept longer than necessary for good care. For medical data, this retention period is generally 20 years (from the last treatment), unless longer storage is necessary, for example, for your health or your children's health. This is up to the practitioner's review.

Your Rights as a Data Subject

You have the following rights:

  • The right to know whether and which personal data of yours is being processed.

  • The right to inspect your own file (electronically) free of charge or receive an (electronic) copy (insofar as this does not harm another person's privacy).

  • The right to correction, addition, or deletion of data.

  • The right to request (partial) destruction of your medical data. This will only be accommodated if the retention of the data is not significant for someone else and the data is not required to be retained by law.

  • The right to add a personal statement (of a medical nature) to your file.

  • The right to object to the processing of your data in certain cases.

  • The right to obtain information about who has viewed your data (logging).

  • The right to data portability, meaning you can take and transfer personal data to another (care) provider. This right applies to some data in your medical file.

If you wish to exercise your rights, you can make this known verbally or by means of an application form. Your interests can also be represented by a representative (such as a written representative, your curator, or mentor).

Providing Your Personal Data to Third Parties

Employees of Salbar Physiotherapy are obligated to handle your personal data confidentially. This means, for example, that the healthcare provider requires explicit permission to provide your personal data or your child's data. However, there are exceptions to this rule. The duty of silence can be broken by law, or when there is a serious danger to your health or that of a third party. Additionally, data can be exchanged verbally, in writing, or digitally with other healthcare providers (e.g., the GP) if necessary.

Transfer of Your File

When choosing a new physiotherapist, it is important that your new physiotherapist is aware of your (medical) history, which is in the patient file. It is common for your former physiotherapist to transfer the file to your new physiotherapist. The former physiotherapist will do this as soon as possible, within one month, after you have requested the file to be transferred. Your file will then be transferred personally by your physiotherapist or by registered secured mail. You do not receive the original file but always have the right to inspect your file or your child's file and obtain a copy. The file can also be sent to the new physiotherapist by email if possible. Both physiotherapists must ensure their computer and internet connections are sufficiently secured.
